Rosebud Sioux Tribe Attorney General Is Attempting to Strip Our Sovereignty

 I recently have been hearing about this newly proposed garnishment law and weapons law.  I finally received the proposed laws set for public hearings.  I have to say, I was at a complete lose of words by what the Rosebud Sioux Tribe Attorney General Lloyd Guy and his interns have proposed.  The Tribal Membership really need to read these proposed laws and recognize how it completely strips Tribal Members and the Tribe of Sovereignty.  I red a comment from Tribal Member Rose Cordier, and, I want to praise Rose Cordier for her very intelligent comment to Attorney General Guy.  Rose Cordier didn't just hit the nail on the head she drove that nail home.  Thank you Rose.

In the Rosebud Sioux Tribe Attorney General Ordinance 88-01 it spells out the duties of the RST Attorney General.  One of the most important duties of the RST Attorney General is, to protect the rights (Civil Rights) the Indian Civil Rights Act of the Tribe and its Membership.  These two newly proposed laws are blatantly contradictory to the lawful duties of the RST Attorney General.  The 1868 Fort Laramie Treaty grants the Rosebud Sioux Tribe and its Membership Sovereignty under several Articles of the Treaty.  Federal and Tribal Laws protect our Sovereignty and we have a guy who resigned attempting to strip our Tribe and Membership of its lawful granted sovereignty on his way out the door for his personal gain.

We have a process called Tribal Civil Court, if an off reservation business or individual want to seek money judgements and have a process to follow according to Tribal Law.  The RST Attorney General wants to sell out our sovereignty and tell non Indians they can now have our pay or other source of income garnished to pay non-Indian businesses.  We have a process in place as I stated already in the Tribal law and Order Code.  This Garnishment law public hearing is scheduled for February 24, 2023 in the Rosebud Sioux Tribal Council Chambers.  The Weapons law public hearing his scheduled for this Friday, February 17, 2023, in the Tribal Council Chambers.

Well Mr. Guy, your proposed laws and the language is a blatant and direct violation of Tribal Members Constitutional Rights and the Weapons law is in direct violation of the second amendment of the United States Constitution.  Any legislator (Tribal Council Representative) should be able to read this and recognize this is not only a violation of Civil Rights but a direct attack on our Sovereignty.  If the Tribal Council even considers thesis laws that strop Tribal Members of Sovereignty and our Civil Rights should not only resign bit should be removed from Office for failure to uphold the Constitution and Oath of Office.

If you read the last paragraph of the proposed garnishment law, the RST Attorney General states, As you may have noticed, many people are out there committing slander, libel and defamation of character against administration, the council, as well as this office.  at present, these folks have nothing to lose, while good people will be left with their reputation in shambles and they might not recover professionally.  Garnishment may serve as a document to this reckless behavior.  OH NO YOU DIDN'T.

Mr. Guy, you're suppose to protect our sovereignty and our Civil Rights.  It seems as some Tribal Elected Officials as well as your ego and feelings are hurt with a statement like that.  For you to make a statement like that you are stating we do not have freedom of speech, expression, or to petition or government.  Being an elected official and an attorney general comes with disagreement and criticism.  Holding these positions requires thick skin and professional restraint as it comes along with the job.

Apparently you do not pay attention to national events in relation to elected and appointed officials.  No matter what channel I watch, I can see elected officials being criticized by media outlets and United States Citizens.  One party is openly criticizing the United States Attorney General. You do not see them throwing childish temper tantrums about their feelings being hurt?  So you see them attempting to disregarding Civil Rights and being allowed to get away with it? NO YOU DON'T.

So, I want you to go to the Tribal Courthouse and file on behalf of your last paragraph in the proposed garnishment law against all of us.  I dare you to, and I want to see you convince a judge because you and a few elected officials feelings and ego got hurt, you're going to convince, a judge to disregard our Constitutional and Civil Rights of freedom of speech and press.  This further proves you incompetence and that statement of your personal opinion in a proposed law proves your incompetence and unfit for the position you continue to hold. This will be reported to the South Dakota Bar Association and with supporting documents proving you intent behind that personal opinion in a proposed law.

You need to immediately remove them South Dakota License Plates reading Sovernt (Sovereign) from your vehicle.  That is a blatant display of hypocrisy and the people need to contact all 20 Tribal Council Representatives and tell them to take a stand and protect Tribal Sovereignty and based on the actions of Mr. Guy and immediately terminate him for attempting to erode Tribal Sovereignty and Tribal Members Civil Rights.  Mr. Guy if you want to point fingers about people putting professional careers in shambles, own yours, take responsibility for your incompetence and you should be held accountable for jeopardizing Tribal Sovereignty.  

I think if our Elected Leaders attempt to be as incompetent as Mr. Guy they should be removed from Office.  This is common sense and any elected leader can read and understand the history of Tribal Sovereignty.  If We The People can understand it, the Tribal Council should immediately disapprove and stop the attack on Tribal Sovereignty and Tribal Members Civil Rights.  

In the Weapons proposed law, 5-11-134 it states the banishment of non-Members and MEMBERS.  MEBERS Mr. Guy?  We have a banishment law in place in our Law and Order Code and no where does it say MEMBERS.  Apparently your incompetence is through the roof and you do not understand the history of the laws and Federal Acts pertaining to IRA.  We were placed her we have Treaties, our constitution and Federal Acts states laws, we have a rights to be in legal terms in a Indian Reservation.  Who are you to propose to violate our rights and banish Tribal Members?

He history of our communities and what families reside in these communities generation after generation.  Your incompetence proves an unspeakable amount of disrespect to the Lakota Culture and Traditions.  If the Tribal Council condones this behavior and attack on Tribal Sovereignty and Civil Rights, again, you need to resign to be removed.  I believe the Bad Man Clause under the 1868 Ft. Laramie Treaty now needs to be exercised against Mr. Guy and the people need to file to have him Banished from the Rosebud Sioux Tribe for this incompetent act of his.

Mr. Guy your incompetence and arrogance blinds and causes you to be deaf to the Tribal Memberships drum beating.  We have now come together to the drum beat that heart beat and we are dancing and taking a stand against corrupt and dishonest acts.  We are exercising our rights and we will see that our rights are honored.  We will not stop the movement we started and it will continue and this is all the doing of you and the elected officials who have hurt feelings for disrespecting the Tribal Membership and attacking our Sovereignty and Civil Rights.
