How Unethical Can the Rosebud Sioux Tribe Attorney General Get?
This article is to address the above attached Facebook post by the Rosebud Sioux Tribe Attorney General Lloyd Guy. Attorney General Guy posted a meme and directly below his name, Lloyd Guy, his comment states, "Especially from a felon." I am a felon, I'm human I made a mistake and I can publicly admit that. I also own that I'm a felon and openly discuss it as it's not top secret information. What we have with this facebook post by the Rosebud Sioux Tribe Attorney General Lloyd Guy are some serious issues at hand that he should publicly answer for.
I remind the public to request a copy of Rosebud Sioux Tribe Ordinance 88-01, Rosebud Sioux Tribe Attorney General Ordinance. In RST Ordinance 88-01, Section 7. DUTIES AND RESPONSIBILITIES, D) states, Protection of Tribal Members and the interests of the Rosebud Sioux Tribe in the Tribal, State, and Federal courts in litigation and cases involving Criminal Law, Federal Civil Rights, Juvenile Justice and Indian Law. Provide for the protection of all minors, mentally incompetent and any others who need protection and assistance for reason of health, age, or other extenuating circumstances. What this means is the Rosebud Sioux Tribe Attorney General Guy legal responsibility is to protect ALL Tribal Members Civil Rights to make sure they are not violated.
I can only assume the Rosebud Sioux Tribe Attorney General Guy is discriminating against all felons. We have felons who sat on our Tribal Council, who sat on out Tribal Council, who are Spiritual Leaders, and work in our Tribal Programs, and who are Tribal Members. We should demand a public answer from Attorney General Guy who he is talking about in reference to "Especially a felon." Under Federal Discrimination Laws, it makes legal reference to a classification, a classification of people, felons are a classification of people. So, all of us Tribal Members who are felons are protected by classification against discrimination.
Let's say Attorney General Guy is directing his facebook post towards me. "I love listening to people lie when I know the truth." If you recall Attorney General Guy, I requested a public forum with you several times that you have failed to call or host a public forum. You continue to hide from the Tribal Council as they have stated repeatedly, we have to heard a report from the Attorney General for three to four months now. Lets discuss how serious this facebook comment it by the Rosebud Sioux Tribe Attorney General.
1. I individual holding the position of Attorney General has a vast legal responsibility. This position comes with professional legal restraint. Professional restraint is refraining from posting discriminating comments while holding a title of Chief Law Enforcement Officer of Tribal Law.
2. When Attorney General Guy makes the comment, "Especially from a felon," Attorney General Guy is talking about all Tribal Member felons not just me. We have a serious legal ethical issue at hand now. Attorney General Guy's integrity is now compromised.
3. I now question if Attorney General Guy is fit for duty, with his facebook comment clearly shows he cannot be impartial and is attacking a classification os Tribal Members.
If Attorney General Guy is calling me a liar, then I ask him to prove it. All the statements I put in my last article are the truth based on first hand knowledge and if lawfully requested, I know the documents will prove I'm telling the truth. Like I stated, I own mine, now I'm calling on Attorney General Guy to own his. If you can make the comment on your facebook then own it and stand by it. Free Speech is granted to Tribal Members and United States Citizens. If you are employed in a position such as a Tribal Attorney General you have to have professional restraint, legal ethics, and employment policies such as employee conduct.
Despite my public criticism you still have a legal responsibility to protect us felons Civil Rights. As a felon I can still vote, hold employment in federally funded programs within the Rosebud Sioux Tribe, still seek public office, and the only thing I can't do is possess a firearm. We Tribal Member felons did not surrender or Civil Rights so you can discriminate against us. As stated before, with your facebook comment, this proves you are unfit to hold the position of the Rosebud Sioux Tribe Attorney General. We felons are not less human, this is not North Korea, we Native Americans have a blanket of Civil Right protections, the most protection is any race of individuals. Attorney General Guy, you of all people should understand that.
The Rosebud Sioux Tribal President according to the Rosebud Sioux Tribe Constitution and By-Laws supervises all Tribal Employee's including the Rosebud Sioux tribe Attorney General. I want a public answer from the Tribal President as well as Attorney General Guy how it's lawful to discriminate against a classification of Tribal Members. A facebook comment like that is well outside of the protection under the color of law. I believe Attorney General Guy's facebook comment just subjected him to a class action lawsuit by all Tribal Member felons or all felons in general. If I was one Tribal Council Representative I would be furious with the Attorney General Guy about his discriminating facebook comment and demand he be terminated or resign.
Attorney General Guy we have names, we have Lakota names and our names are not felon. I know you have read majority of my articles, especially the articles pertaining to you. I know you are tired of being blogged about. Do your job, follow your job description in RST Ordinance 88-01 because no other job description supersedes a Tribal Ordinance. So your Duties and Responsibilities is Tribal Law, RST Ordinance 88-01 is law and you are violating the law by failing to protect Tribal Members Civil Rights.
This is you prime example of the 1868 Ft. Laramie Treaty Article 1, Bad Man Clause. We now have a Bad Man hold the position of Attorney General of the Rosebud Sioux Tribe. I stand by a belief I have, the difference between a politician and a leader is, a politician is invested in a individual or a group of individuals. A leader is invested in everyone as a whole the whole Tribal Membership. What I have seen lately is our elected leaders invested in individuals or a certain people and us Tribal Members are locked out of our public building and public meetings. So I ask the Tribal President, are you a politician or you a leader? Tribal Council, are you politicians or is the Tribal Council leaders?
Let see who's lying Attorney General Guy, let's see if you lie and sell you soul to our elected leadership to save that big paycheck. In all reality Tribal Council are only legislators they have no administrative authority. This issue is directly in the lap of the Tribal President for the actions of the Attorney General. Attorney General Guy, I want to remind you again, we have had elected officials, current elected officials, Spiritual Leaders, and us who are just common men and women who are felons. I have never in my lifetime or historically heard an Attorney General speak this way, behave this way, and be in blatant violation of his legal ethical duties and responsibilities as you.
So Mr. Tribal President, do you condone your Tribal Attorney's behavior, are you going to defend his facebook comment? Are you going to throw Tribal Members under the bus? I ask the Tribal Membership, When is enough going to be enough of us being treated like this. Our Attorney General and Elected Officials are displaying the same behavior as the Washington D.C. Grand Ol Party (GOP) dictated by Donald Trump.
Respectfully,
Hawkeye Waln
