The Time is Now for a Rosebud Sioux Tribe Tribal Grand Jury
With all the current Civil Rights Violations occurring by the Rosebud Sioux Tribe Attorney General and Rosebud Sioux Tribe Chief Prosecutor, it is time for a Tribal Grand Jury. Some people may ask why a Tribal Grand Jury. The Federal and State Judicial branches have a grand juries and procedures for grand juries. A grand jury is used for alleged felony offenses in the Federal and State Judicial systems. I think with the failed Rosebud Sioux Tribe Judicial system we are operating with now, how the system is violating Tribal Members Civil Rights, a Tribal grand jury would put some checks and balances in place.
I 'll keep stating, we have a Tribal Court who is suppose to uphold the Constitution of the Rosebud Sioux Tribe and Indian Civil Rights Act. The Rosebud Sioux Tribal Judicial System is in clear violation of the Rosebud Sioux Tribe Constitution and the Indian Civil Rights Act with its unethical practices. As stated before, the common practice by our Tribal Judicial branch is, Rosebud law Enforcement will arrest for breathing and request a $5,000 or greater bond against you. The Tribal Chief Prosecutor will issue a criminal complaint against a piece of fry bread, and argue for the unconstitutional high bond.
Next you have a criminal court Magistrate Judge does not possess all the necessary qualifications to hold what is viewed as a certified Judge in a Court of Law. The Judge sets the unconstitutional bond based on a police report and limited evidence. No Probable cause hearing is held to review the evidence to see if probable causes exists. As stated before, the Tribal Member sits almost six months with no other hearing on the unconstitutional bond. No follow up is conducted on the alleged offense and the Chief Prosecutor offers a plea agreement for time served and a fine to make the Civil Rights Violations go away to cover her rear end.
With a Tribal Grand Jury, a full and complete investigation would have to be completed with factual evidence, lab report, DNA, witness cooperation, and witness interviews in order to present the case to the Tribal Grand Jury. A Tribal Grand Jury could be made up of 11 to 21 Tribal Members. The Chief Prosecutor would have to present all evidence to the Tribal Grand Jury in hopes to get a True Bill meaning a Tribal Indictment or Criminal Complaint can be issued with an arrest warrant. If the Tribal Grand Jury issues a No Bill, then that means the Grand Jury has decided the Tribal Chief Prosecutor has not proven her case and the Tribal Member will not be indicted.
This is where the checks and balances come into play under the United States Constitution Bill of Rights, Indian Civil Rights Act Bill of Rights, and the Rosebud Sioux Tribe Constitution Article X Bills of Rights. The Rosebud Sioux Tribe Chief Judge and the Tribal Council have failed us Tribal Members for not creating Tribal Court or bob procedures. Having a Tribal Grand Jury actually makes Law Enforcement and the Tribal Prosecutor's office do their jobs. No more half ass investigations and Civil Rights violations by the Tribal Attorney General and Tribal Chief Prosecutor. They would have to present facts and real evidence in order to obtain a Tribal indictment.
With a Tribal Grand Jury, you wouldn't see Tribal Police sitting along the road on their cell phones all the time. This will eliminated if perceived, I can do what I want arrogant mentality of the Tribal Chief Prosecutor. No more throwing paper witness statements at us and driving off the opposite direction and never come back to pick the statements up. Being forced for follow up on cases, ensuring everyones rights are protecting who are involved in the case. They would have to actually work and earn that big salary and protect Tribal Members Civil Rights. I can guarantee you this, a Tribal Grand Jury would not indict 90 plus percent of cases presently without proper investigations and evidence to include lab reports and DNA.
The Federal and State Judicial systems do not present a case to Grand Jury unless the investigation is complete and they have solid evidence. Not the Tribal Judicial system though, they are in the business of violating Civil Rights. A Tribal Grand Jury was discussed before at the Tribal level, the typical outcome, a lot of talk and no action. It's sad the Tribe has countless attorneys employed and on contract and we have these serious issues of Civil Rights violations happening daily.
A quick example of needlessly wasting Federal Money allocated to the Tribe. You have a Tribal Member sitting on a $100.00 yes One Hundred dollar cash bond for over five months. A daily cost is associated with housing an incarcerated Tribal Member and strains the Corrections program budget. This is the prime example of the arrogance level of the Tribal Chief Prosecutor.
Again, I will stress I do not condone criminal activity and if the evidence against a Tribal Member is overwhelming then consequences follow. I'm exposing a broke system that has and is continuously violating Tribal Members Civil Rights. Majority of the Tribal Members incarcerated are on unconstitutional bonds and the Rosebud Sioux Tribe has no bond procedures or court procedures. What if every inmate requested a bond hearing, asked the Tribal Chief Prosecutor to produce the Tribal bond procedures, requested probable cause hearing to prove probable cause exists like, real probable cause not arrogant probable case.
What if every Tribal Member charged with a Class A offense requested a jury trial, does the Tribal Chief Prosecutor have all necessary evidence to convince a Tribal jury beyond a reasonable doubt? These are rights of Tribal Members can exercise. What would the Chief Prosecutor do if they she presented with a Discovery request by a Tribal Member? You know Miss Tribal Chief Prosecutor, the law states, a Tribal member under discovery is mandated to receive everything you have against them as they have a right that information, call witnesses and cross examine witnesses. So what if every incarcerated Tribal Member submitted a Discovery request. My bet is, you would continue to ignore it, come up with some arrogant excuse to further violate their Civil Rights.
It's time for a Tribal Grand Jury and if the Tribal Attorney General want to continue to ignore my requests and stay in his hole while still Violating Tribal Members Civil Rights, then I 'll write the the Tribal Grand Jury Procedures. It's not rocket science, but if you want to continue to be incompetent, complacent, and continue to violate Tribal Member's Civil Rights, then resign, before your disbarred or the Federal Civil Rights Division eventually steps in. The Whole Tribal Judicial Branch are exercising an arrogance level that is through the roof. They forget what is going on nationally with the Federal and State Government's holding Law Enforcement and Attoney's accountable for Civil Rights Violations. They think its just Rosebud no one will know or investigate Civil Rights Violations.
Remember Native Americans have the most Civil Rights protection of any race. We have a blanket of Civil Rights protection in our favor but the Tribal Attorney General who is suppose to protect out Civil Rights think we're all stupid. For the public who follow my articles, I want to keep you up to date, the Tribal Attorney General to present day, has not provided me with any Tribal Court procedures, Tribal bond procedures, and has not contacted me about setting up a public forum regarding these Civil Rights Violations.
I want to thank all of you I see in public, who call me, and who text me regarding the articles. Your support is humbling and I respect you all for your support. It takes us Tribal Members to change these serious issues and if you want to help like you expressed, I encourage and welcome your assistance and support. Its simple, flood you Tribal Council Representative and Tribal President with calls, approach them in person and express your concerns about these issues to them. Remember we have the right to freedom of press, speech, expression, to peaceable assemble, and petition our government.
With that being said, the Tribal Attorney General ignoring me and not protecting out Civil Rights, I call for the Rosebud Sioux Tribe Judicial Committee to invite me to a special called Judiciary meeting so everything is a matter of record and recorded. I ask for just two hours of your time, you can at least give us Tribal Members that its only two hours of your day. I will follow up wit a letter of request to the RST Judiciary Committee chairperson for a meeting with just the Judiciary Committee and me. I want to express and advocate the mandated importance of Tribal Member Civil Rights. Let's see if us Tribal Members are important enough and get the time from our Elected Officials our we going to get the continuous cold should as usual.
